Calling for Help in an Overdose
RSA 318-B:28-b — a defense to possession for the one who calls, and for the one overdosing
It is a defense to possessing a controlled drug that the person, in good faith and in a timely manner, requested medical assistance for someone experiencing a drug overdose, or reported that someone had been the victim of a violent crime.
Who handles this in New Hampshire: New Hampshire Bar Association Lawyer Referral Service; and legal aid programs and the state offices, listed in the New Hampshire directory.
The same defense belongs to the person experiencing the overdose who requests help for themselves, and to the victim of a violent crime who reports it, in good faith and in a timely manner.
