Signing a Will
RSA 551:2 — in writing, signed, and witnessed by 2 or more
Every person 18 or older, and a married person under that age, of sane mind, may dispose of their property by a written will.
Who handles this in New Hampshire: New Hampshire Bar Association Lawyer Referral Service; and legal aid programs and the state offices, listed in the New Hampshire directory.
- It is in writing.
- It is signed by the person making it, or by someone at their express direction in their presence.
- It is signed by 2 or more credible witnesses who, at the person's request and in their presence, attest to the signature.
A will is revoked by another valid will or codicil, by a writing signed the same way, or by canceling, tearing, obliterating or otherwise destroying it, by the person or by another with their consent and in their presence, as the section provides.
