Signing a Will
Section 45-2-502 — in writing, signed, and signed by two witnesses in each other's presence
- In writing.
- Signed by the testator, or in the testator's name by someone else in their conscious presence and at their direction.
- Signed by at least two individuals, each signing in the presence of the testator and of each other after witnessing the testator's signing.
Who handles this in New Mexico: Senior Citizens' Law Office; and legal aid programs, lawyer referral and the state offices, listed in the New Mexico directory.
A will may be made self proved at signing, by the testator's acknowledgment and the witnesses' affidavits under penalty of perjury before an officer authorized to give oaths, in the form the section sets out.
Anyone generally competent to be a witness may witness a will, and an interested witness's signature does not invalidate the will or any part of it.
