Moving Away with a Child
Ala. Code § 30-3-169.4 — a move is presumed not in the child's best interest, and the parent moving proves it first
In a relocation case, a change of the child's principal residence is presumed not to be in the child's best interest, unless the parent objecting has been found to have committed domestic violence or child abuse.
Who handles this in Alabama: legal aid programs, lawyer referral and the state offices, listed in the Alabama directory.
The parent seeking the move carries the first burden of proof. If that parent meets it, the burden shifts to the parent who is not moving.
