Fired for a Workers' Comp Claim
AS 23.30.247 — no discrimination in hiring, promotion or keeping a job over a good faith claim
An employer may not discriminate in hiring, promotion or retention against an employee who in good faith filed a claim for, or received, workers' compensation. An employer who does is liable to the employee for damages a court assesses in a private lawsuit.
Who handles this in Alaska: legal aid programs, lawyer referral and the state offices, listed in the Alaska directory.
The law does not stop an employer from basing those decisions on the employee's safety practices or physical and mental abilities, and does not create job rights that did not already exist.
