Getting Out Before Trial

AS 12.30.011 — release on a promise or an unsecured bond, and a new address told within 24 hours

Unless the chapter on release says otherwise, a judicial officer releases a person charged with an offense on their personal recognizance or an unsecured appearance bond, on four conditions.

Email

Who handles this in Alaska: Alaska Bar Association Lawyer Referral Service; and legal aid programs and the state offices, listed in the Alaska directory.

  • The person obeys every court order and every law.
  • The person comes to court when ordered.
  • The person keeps in touch with their lawyer, if they have one.
  • The person lets their lawyer know within 24 hours after moving, and the lawyer passes it on to the prosecutor and the court.

If that release will not reasonably make sure the person comes back, or will put the victim, others or the community in danger, the officer imposes the least restrictive conditions that will.
