A.R.S. 13-3883 — when an officer may arrest without a warrant
An Arizona peace officer may arrest without a warrant on probable cause to believe that:
- A felony has been committed and the person committed it.
- A misdemeanor has been committed in the officer's presence and the person committed it.
- The person was involved in a traffic accident and violated a criminal section of the transportation title just before or after it.
- A misdemeanor or a petty offense has been committed and the person committed it, in which case the person is eligible for release under the citation section.
- The person committed a public offense that makes the person removable from the United States.
Separately, an officer may stop and detain a person as reasonably necessary to investigate a traffic violation committed in the officer's presence, and serve the traffic complaint within a reasonable time.
