Where Nobody May Smoke
A.R.S. 36-601.01 — the Smoke-free Arizona Act: all public places and places of employment
The rule. Smoking is prohibited in all public places and places of employment within Arizona, except the places the act lists.
- Private residences, except when used as a licensed child care, adult day care or health care facility.
- Hotel and motel rooms designated as smoking rooms, with not more than fifty percent of rented rooms so designated.
- Retail tobacco stores physically separated so their smoke does not reach smoke free areas.
- Veterans and fraternal clubs when not open to the general public.
- Outdoor patios, so long as smoke does not enter areas where smoking is prohibited.
- Religious ceremonies under the American Indian religious freedom act, and theatrical or film performances where smoking is part of the performance.
Employees are told. The prohibition in places of employment is communicated to existing employees and to prospective employees when they apply.
