Civ. Code 1689.6 — three business days to cancel, five for a senior
In California, a home solicitation contract or offer is one for the sale, lease or rental of goods or services, of $25 or more, made somewhere other than the seller's normal place of business.
The buyer may cancel until midnight of the third business day, or the fifth for a senior citizen. In addition to any other right to revoke an offer, the buyer may cancel a home solicitation contract or offer until midnight of the third business day after signing, or of the fifth business day if the buyer is a senior citizen. For a personal emergency response unit, and for repairing a home damaged by a disaster, the period runs to midnight of the seventh business day.
The agreement is written in the language principally used in the sales presentation, dated and signed by the buyer, with a conspicuous statement near the signature of the right to cancel. The first page gives the seller's name, address and email address for the notice, the date the buyer signed, and a telephone number for help with the form, and a completed Notice of Cancellation form is attached in duplicate.
Within 10 days after a cancellation, the seller returns any payments the buyer made and any note or other evidence of debt, and goods traded in come back in substantially as good condition as when received.
Some home improvement contracts written under the Business and Professions Code follow their own cancellation rules, and a vehicle that must be registered under the Vehicle Code is not goods under the section.
