Handing Over A Firearm
Penal Code 27545 — when neither party is a dealer, the sale, loan or transfer goes through a licensed dealer
Through a dealer. Where neither party to the transaction holds a firearms dealer's license, the parties complete the sale, loan or transfer of the firearm through a licensed firearms dealer, under the chapter the section names.
Exceptions, among them some transfers within a family, are set out in other sections that are not on this page. Federal law adds its own rules on transfers, including to people who live in another state, which are not on this page. Whether a particular sale, loan or gift is lawful is a question for a licensed California attorney.
