Paraphernalia
Health & Saf. Code 11364 — an opium pipe or a device for unlawfully injecting or smoking the listed controlled substances
What is unlawful. It is unlawful to possess an opium pipe, or any device, contrivance, instrument or paraphernalia used for unlawfully injecting or smoking the controlled substances the section lists, or a narcotic drug in Schedule III, IV or V.
Syringes for personal use. As a public health measure to prevent the spread of HIV, viral hepatitis and other bloodborne diseases, the section does not apply to possessing hypodermic needles or syringes solely for personal use, or to ones containerized for safe disposal.
Drug checking. The section does not apply to an individual obtaining controlled substance checking services under the article the section names.
What counts as drug paraphernalia is defined elsewhere in the law, and the cannabis rules have their own page. Whether an object found in a particular search is paraphernalia is a question of fact and law for a licensed California attorney.
