A Small Estate
C.R.S. 15-12-1201 — an affidavit, ten days after the death, with no probate pending
- The property subject to a will or intestate succession, less liens, is worth no more than the limit the section sets, which moves with the cost of living.
- At least ten days have passed since the death.
- No application or petition for a personal representative is pending or has been granted anywhere.
- Each person named is entitled to what the affidavit lists.
Who handles this in Colorado: Denver District Court Self-Help Center; and legal aid programs and the state offices, listed in the Colorado directory.
A Colorado bank, debtor or other holder of the decedent's personal property pays or delivers it to the successor who presents an affidavit stating those things. A transfer agent changes a security's registration, and a public official the registered title, on the same affidavit.
