Tobacco and Vapes Under Twenty One
C.R.S. 18-13-121 — a $200 civil fine for selling or giving one to anyone under twenty one
No one may give, sell or offer a cigarette, tobacco product or nicotine product, including an electronic cigarette or other device that delivers nicotine, to anyone under twenty one years of age, and the seller must ask for and examine a government issued photo ID first.
Who handles this in Colorado: legal aid programs and the state offices, listed in the Colorado directory.
A violation is a civil infraction with a fine of $200. Relying reasonably on a photo ID showing twenty one or older is a defense. A city or county may set stricter rules, but never an age below twenty one. A particular ticket is a question for a licensed Colorado attorney.
