Grandparent Visitation
13 Del. C. § 2412 — a grandparent, aunt, uncle or adult sibling may ask, and a parent's objection must be shown unreasonable
An adult may petition for visitation with a child not their own if they have a substantial and positive prior relationship with the child, or are the child's grandparent, aunt, uncle or adult sibling.
The Court grants it only if visitation is in the child's best interests and, as to each parent, one of these is true:
- The parent consents.
- The child is dependent, neglected or abused in the parent's care.
- The parent has died.
- The parent objects, but the petitioner shows by clear and convincing evidence that the objection is unreasonable, and that visiting will not substantially interfere with the parent and child relationship.
