Housing Discrimination
6 Del. C. § 4603 — source of income and housing status among the protected grounds, a year to complain, and 2 years to sue
It is unlawful to refuse to sell or rent a dwelling, to set different terms or services, or to advertise a preference, because of race, color, national origin, religion, creed, sex, marital status, familial status, source of income, age, sexual orientation, gender identity, disability, military status, or housing status.
- A complaint may be filed with the Division within 1 year after the practice occurred or ended, or was or should have been discovered.
- The Division serves the respondent within 10 days, and aims to finish its investigation within 100 days.
- A civil action may be filed in the county where it happened within 2 years.
Certain owner occupied and religious housing has limited exemptions. A particular case is a question for a licensed Delaware attorney.
