Intimate Images
11 Del. C. § 1335 — sharing a nude image without consent, recording in a changing room, or hiding a tracker on a car
- Knowingly distributing or publishing an image of a person who is nude or engaged in sexual conduct, knowing it was without the person's consent and was made or shared under circumstances where they expected it to stay private.
- Recording or photographing someone dressing or undressing, or exposed, in a place where people disrobe, such as a fitting room, locker room or bathroom.
- Installing a device in a private place to observe or record without consent.
- Knowingly installing a location tracking device on a vehicle without the owner's or lessee's consent, apart from police and a parent tracking a minor child.
Most violations of privacy are class A misdemeanors. Recording someone undressing, and the more serious forms of distributing intimate images, are class G felonies.
Platforms have their own removal processes. A particular case is a question for a licensed Delaware attorney.
