Calling For An Overdose

Fla. Stat. 893.21 — no arrest or charge for possession found because someone called for help

In Florida, a person who in good faith seeks medical help for someone experiencing, or believed to be experiencing, an alcohol-related or drug-related overdose may not be arrested, charged, prosecuted or penalized for the possession offenses the section lists, when the evidence was found because of the call for help. The person who overdosed has the same protection.

  • Neither may be penalized for violating pretrial release, probation or parole on evidence found because of the call for help.
  • The protection is not grounds for suppressing evidence in other criminal prosecutions.
