Physical Control

Fla. Stat. 316.193 — driving, or in actual physical control of a vehicle, while impaired

Physical control. A person is guilty of driving under the influence if the person is driving or in actual physical control of a vehicle in Florida and is under the influence to the extent that normal faculties are impaired, or has a blood or breath alcohol level of 0.08 or more.

The section reaches control as well as driving, but does not itself define actual physical control. Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Florida attorney.
