Police Radio In A Vehicle
Fla. Stat. 843.16 — a police band receiver in a vehicle or business, outside the listed exceptions, is a misdemeanor
Florida's rule is section 843.16. A person may not install or transport, in any motor vehicle or business establishment, frequency modulation radio receiving equipment adjusted or tuned to receive messages on frequencies the Federal Communications Commission assigns to police or law enforcement officers or fire rescue personnel of a city or county, or to the state or its agencies. The exceptions in that sentence are an emergency vehicle, a crime watch vehicle, and a place established by a government for governmental purposes.
- A holder of a valid amateur radio operator or station license issued by the Federal Communications Commission.
- A recognized newspaper or news publication engaged in covering the news on a full-time basis.
- A certified alarm system contractor operating a central monitoring system.
- A sworn law enforcement officer or emergency service employee using personal transportation to and from work.
- An employee of a government agency holding a valid Federal Communications Commission station license, or an agreement allowing access to another agency's radio station.
A crime watch vehicle needs written approval. A crime watch vehicle is one used by a person in a citizen crime watch or neighborhood watch program, where the program and the use are approved in writing by the sheriff or chief of police where the vehicle will be used and the vehicle is assigned the county's or city's frequencies. The approval is renewed annually.
Those are the people and uses the section says it does not apply to. A violation is a misdemeanor of the first degree.
