Fla. Stat. 741.29 — arrest on probable cause, with no consent from the victim required

The arrest. When an officer determines on probable cause that an act of domestic violence has been committed, the officer may arrest the person or persons suspected and charge them. The decision does not require the victim's consent or consideration of the parties' relationship.

The report. Whether or not an arrest is made, the officer makes a written report clearly indicating domestic violence. If the officer decides not to arrest, or to arrest two or more parties, the report states the grounds.

The victim. The investigating officer assists the victim in obtaining needed medical treatment, advises the victim of the domestic violence center, and administers a lethality assessment as the section requires.
