Deductions from Pay

HRS 388-6 — no fines, register shortages, breakage, or bounced checks out of wages

An employer may deduct or keep part of an employee's pay only where a federal or state statute or court process requires it, or the employee authorizes it in writing. Some things may not be taken even with authorization:

  • Fines.
  • A shortage in a till shared by two or more people, or in one under the employee's sole control unless the employee could account for the money at the start and end of the shift.
  • Fines, penalties or replacement costs for breakage.
  • Losses from accepting checks later dishonored, where the employee had discretion to accept them.
  • Losses from faulty work, lost or stolen property, damage, or customers not paying, unless the employee wilfully disregarded the employer's interest.
  • Medical examinations or reports the employer requires.
