Speeding in a School Zone or Work Zone
HRS 291C-104 — a $250 fine, and a $25 surcharge for the safe routes to school fund
No one drives faster than the maximum speed limit set for a school zone or construction area. The director of transportation and the counties set those limits, the director signs school zones, and whoever is responsible for construction provides signs in construction areas, plainly visible under ordinary conditions.
Who handles this in Hawaii: Hawaii State Bar Association, Lawyer Referral and Information Service; and legal aid programs and the state offices, listed in the Hawaii directory.
- A violation is a $250 fine, with up to $100 more for the trauma system fund.
- In a school zone, a $25 surcharge goes to the safe routes to school program fund.
- Thirty miles an hour or more over the zone's limit, or 80 miles per hour or more, is excessive speeding instead, with its own sentence.
A school zone is every street and all public property near a school as the department of transportation and the counties designate. A construction area is any area of highway work, from paving and curbs to trenches and utility work in the right-of-way.
