A Death Somebody Caused
Idaho Code § 5-311 and Idaho Code § 5-219 — the heirs or the personal representative sue, within two years
When a death is caused by the wrongful act or neglect of another, the heirs, or the personal representative on their behalf, may sue the person responsible, or that person's estate, for such damages as are just in the circumstances.
Heirs include those who would inherit, and the spouse, children, stepchildren and parents, along with others partly or wholly dependent on the person for support.
Two years. An action for a death caused by the wrongful act or neglect of another, or for an injury to the person, is brought within two years.
