Child Support
Idaho Code § 32-706 — support until eighteen, or nineteen while still in high school
In a divorce or child support case, the court may order either or both parents to pay an amount reasonable or necessary for the child's support and education until the child is eighteen, without regard to marital misconduct. It considers the child's resources, both parents' resources, needs and obligations, the standard of living during the marriage, the child's physical, emotional and educational needs, medical coverage, and who claims the tax exemption.
Who handles this in Idaho: legal aid programs and the state offices, listed in the Idaho directory.
Still in high school. If the child continues high school after turning eighteen, the court may continue support until the child stops attending or turns nineteen, whichever is sooner.
Changing an order. Support can be modified only for installments due after the motion is filed, and only on a substantial and material change of circumstances. The court may credit arrears for stretches longer than 120 days in which the children lived primarily with the paying parent with the other parent's knowledge and consent.
The amounts are set by the Idaho Child Support Guidelines in the court rules rather than in the statute. How they apply to a particular household are questions for a licensed Idaho attorney.
