Housing Discrimination

Idaho Code § 67-5909 — no refusing to rent, sell or negotiate because of race, color, religion, sex, national origin or disability

In real estate transactions, the Idaho Human Rights Act forbids discrimination because of race, color, religion, sex, national origin or disability, by owners, landlords, brokers and agents.

  • Refusing to sell, rent or negotiate with someone.
  • Different terms, conditions, facilities or services.
  • Refusing to take or pass on a genuine offer.
  • Saying a place is not available for inspection, sale or rental when it is.
  • Lenders discriminating in financing to buy, build or repair a home.

Inducing sales by warnings about who is moving in, and deed clauses restricting who may buy or live there, are also forbidden. A particular case is a question for the Idaho Human Rights Commission or a licensed Idaho attorney.
