Idaho Code § 37-2732 — three ounces or less of marijuana a misdemeanor with a $300 minimum fine, more a felony

Marijuana is not legal. Possessing marijuana, including any extract or preparation containing tetrahydrocannabinol, is a crime. Three ounces or less is a misdemeanor, with a fine of not less than $300 for a person eighteen or older on top of up to one year or a fine of up to $1,000. More than three ounces is a felony carrying up to five years and a fine of up to $10,000.

  • A schedule I narcotic or a schedule II substance: a felony, up to seven years or a fine of up to $15,000.
  • LSD: a felony, up to three years or a fine of up to $5,000.
  • Other schedule I nonnarcotics, and schedules III through VI: a misdemeanor, up to one year or a fine of up to $1,000.

Those are the penalties for possessing a controlled substance without a valid prescription.

Being knowingly present where drugs are manufactured or held for distribution is a misdemeanor of its own. Manufacturing and delivery carry far heavier terms. A particular charge is a question for a licensed Idaho attorney.
