Idaho Code § 19-3501 — six months to file, six months to trial, unless there is good cause

Six months to file. Where a person has been held to answer and no indictment or information is filed within six months of the arrest, the court must dismiss unless good cause is shown.

Six months to trial. A defendant who did not ask for a postponement must be brought to trial within six months of the information being filed, of the arraignment on an indictment, or for a misdemeanor, of the not guilty plea, or the case is dismissed absent good cause.
