Driving Without Insurance
Idaho Code § 49-1428 and Idaho Code § 49-1229 — a $75 infraction the first time, a misdemeanor within five years after
Every owner of a motor vehicle registered and operated in Idaho continuously provides liability insurance in at least the amount the Code requires, or a certificate of self-insurance, or an indemnity bond with the director of insurance.
$75, then a misdemeanor. Driving on a highway without valid liability insurance is an infraction with a $75 fine the first time. A second or later conviction within five years is a misdemeanor carrying up to $1,000, up to six months, or both.
Proof of insurance is carried in the vehicle and may be shown on a phone, and a person who produces proof of coverage in effect at the time before conviction is not convicted of failing to carry it. A particular case is a question for a licensed Idaho attorney.
