Idaho Code § 18-8004A — 0.02 under twenty-one, a fine of up to $1,000, and a one year suspension

0.02. It is unlawful for a person under twenty-one to drive or be in actual physical control of a motor vehicle with an alcohol concentration of at least 0.02 but less than 0.08.

A first violation is a misdemeanor with a fine of up to $1,000 and a one year suspension, ninety days of which are absolute, after which the court may allow restricted driving.

A second brings a mandatory minimum of five days in jail, up to thirty days, and a fine of $500 to $2,000; a third within five years at least ten days, up to six months, and a fine of $1,000 to $2,000.
