When You Are The Victim
Idaho Code § 19-5306 — present at every proceeding, heard at sentencing, and told of a release
- Treated with fairness, respect, dignity and privacy.
- Present at all criminal and juvenile proceedings, probation proceedings included.
- A timely disposition of the case.
- Notice of court, appellate, probation and parole proceedings.
- Heard on request at a plea, sentencing or release.
- Told of a proposed plea agreement in a violent, sex or child crime.
- Free to refuse an interview by the defense.
- Notified when the defendant is released or escapes.
Those are among the rights of each victim of a crime or juvenile offense. A victim's statement of the impact goes into the presentence report, which the victim may read before sentencing.
A written request. When a complaint is filed, the prosecutor tells the victim of these rights. The victim exercises them by filing a written request on the prosecutor's form with the court clerk.
The rights extend to the immediate family of a homicide victim, or of a victim too young or incapacitated to use them. A particular case is a question for the victim witness coordinator or a licensed Idaho attorney.
