Belongings Left Behind

IC 32-31-4-2 — removal after an eviction takes a court order, and exempt property is released free

A landlord has no liability for a tenant's personal property that is abandoned, meaning a reasonable person would conclude the tenant has vacated and surrendered it, and a lease may not define abandonment any other way.

After winning possession in court, a landlord may ask the court for an order allowing removal of the tenant's property. If the tenant does not remove it by the date in the order, the landlord may deliver it to a warehouse or court approved storage facility, once the order and the storage location have been personally served on the tenant. The warehouse releases exempt property to its owner on demand without payment.

Where a sole occupant dies or is incapacitated, the landlord notifies the tenant's representative, gives access to remove the property, and pays over the deposit and unearned rent the tenant would have been due.
