Reporting Wrongdoing at Work
IC 22-5-3-3 — a public contractor's employee who reports a violation may not be fired or demoted for it
An employee of a private employer under a public contract may report in writing a violation of a federal, state or local law, or a misuse of public resources, concerning the contract, first to the employer unless the employer is the one believed responsible. If no good faith effort is made to correct it within a reasonable time, the employee may report it in writing to anyone.
Who handles this in Indiana: legal aid programs and the state offices, listed in the Indiana directory.
For making such a report, an employee may not be treated in any of these ways.
- Dismissed, or demoted.
- Denied raises or employment benefits, or a promotion otherwise due.
- Transferred or reassigned.
An employer that does commits a Class A infraction. An employee who knowingly furnishes false information may be disciplined, and may appeal that discipline as a civil action.
