Iowa Code § 633.236 — a surviving spouse may take an elective share instead of the will

When a married person domiciled in Iowa dies, the surviving spouse has the right to take an elective share under the sections that follow, and a will's disposal of property is subject to it. A spouse with a conservator may have the court authorize the election.
