Dividing Property in a Divorce
Iowa Code § 598.21 — an equitable division of everything except inheritances and gifts
- The court divides all property equitably between the parties, except property inherited or received as a gift by one of them.
- It considers the length of the marriage, each party's contributions, age, health, earning capacity, pensions and other economic circumstances.
- Inherited or gifted property stays with that party unless refusing to divide it would be inequitable to the other party or the children.
