Drug Paraphernalia
Iowa Code § 124.414 — a simple misdemeanor, and lawful needles and syringes are not paraphernalia
Drug paraphernalia is equipment, products or materials used or attempted to be used with a controlled substance, outside its lawful use, knowingly and primarily to make it, take it into the body, test its strength or purity, or enhance its effect.
- Knowingly or intentionally making, delivering, selling or possessing drug paraphernalia is unlawful.
- Hypodermic needles and syringes made, delivered, sold or possessed for a lawful purpose are not drug paraphernalia.
A violation is a simple misdemeanor.
