A Small Estate Without Probate
K.S.A. 59-1507b — personal property handed over on an affidavit when the probate estate is $75,000 or less
When a Kansas resident dies, with or without a will, and the estate subject to probate is worth no more than $75,000, anyone holding personal property for the estate hands it to a successor who gives them an affidavit showing the right to it, without letters from a court.
Who handles this in Kansas: Johnson County Bar Association, Find a Lawyer; and legal aid programs and the state offices, listed in the Kansas directory.
- A successor is someone entitled to the property under the will or by inheritance, or the personal representative the will names.
- The affidavit follows the judicial council's form.
- The holder who hands the property over is fully discharged, as if it had gone to an executor or administrator.
