Counting a Deadline
K.S.A. 60-206 — skip the day of the event, count weekends, and a last day on a weekend or holiday moves to the next day
- Leave out the day of the event that starts the period.
- Count every day after it, Saturdays, Sundays and legal holidays included.
- Count the last day, unless it is a Saturday, Sunday or legal holiday, in which case the period runs to the end of the next day that is not.
Who handles this in Kansas: legal aid programs, lawyer referral and the state offices, listed in the Kansas directory.
If the clerk's office is inaccessible on the last day, the time runs to the first accessible day that is not a weekend or holiday. The last day ends at midnight for electronic filing, and when the clerk's office closes for anything else.
The legal public holidays are New Year's Day, Martin Luther King, Jr. Day, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day and Christmas Day.
