Getting Public Records
K.S.A. 45-218 — open to any person, acted on by the end of the third business day, and copies at actual cost
All public records are open for inspection by any person, except as the open records act provides, during the agency's regular office hours.
Who handles this in Kansas: legal aid programs, lawyer referral and the state offices, listed in the Kansas directory.
- A request is acted on as soon as possible, and no later than the end of the third business day after it is received.
- If access is not immediate, the custodian explains the delay and gives the earliest time the record will be available.
- On request, a denial comes in writing citing the specific law relied on, by the end of the third business day.
- Someone who is not the custodian tells the requester who is.
Anyone with access may get copies. The agency may ask for payment in advance, but fees for copies may not exceed the actual cost of furnishing them, staff time included.
