Moving with a Child
K.S.A. 23-3222 — 30 days' written notice to the other parent before moving the child or taking them out of state over 90 days
A parent with custody, residency or parenting time gives the other parent written notice at least 30 days before changing the child's residence or taking the child out of Kansas for more than 90 days, by restricted mail, return receipt requested, to the other parent's last known address.
Who handles this in Kansas: legal aid programs, lawyer referral and the state offices, listed in the Kansas directory.
- Failing to give the notice is indirect civil contempt, and the court may make that parent pay the other's attorney fees and costs.
- A move may be a material change of circumstances that justifies changing custody, residency, support or parenting time.
- The court weighs the move's effect on the child's best interests, on the other parent's rights, and the added cost of using them.
No notice is required to a parent convicted of a crime the section lists in which the child was the victim.
