KRS 218A.410 — what is subject to forfeiture, and the owner who did not know

  • Unlawfully possessed Schedule I substances are contraband and forfeited.
  • Money and things of value exchanged for drugs, proceeds traceable to the exchange, and money used to facilitate a violation are subject to forfeiture.
  • Land used to commit or facilitate a violation may be forfeited, but not for a misdemeanor involving marijuana, synthetic drugs or salvia.

No vehicle is forfeited for an act or omission the owner shows was done without the owner's knowledge or consent, and the forfeiture of vehicles does not apply to a misdemeanor offense involving marijuana or salvia.
