Signing Over Authority
KRS 457.050 — a power of attorney signed by the principal, and presumed genuine when notarized
- The principal signs, or another person signs the principal's name in the principal's conscious presence at their direction, and the document then says why.
- A signature acknowledged before a notary public is presumed genuine.
A power of attorney is effective when signed, unless it says it begins on a future date or event. One that begins on incapacity, with no one named to decide that, takes effect when a physician, psychologist, advanced practice registered nurse, qualified social worker, attorney or judge determines it in writing.
