Hurting Someone While Impaired
La. R.S. 14:39.2 — a serious injury caused by an impaired driver is up to 10 years
Vehicular negligent injuring is injuring someone while operating a vehicle impaired by alcohol or drugs, or at a blood alcohol concentration of 0.08 percent or more. It carries up to $1,000, up to 6 months, or both.
- At 0.15 percent but under 0.20, at least 7 days are served.
- At 0.20 percent or more, at least 30 days are served.
Where the injury is serious bodily injury, it is first degree vehicular negligent injuring: up to $5,000, up to 10 years, or both. At 0.15 percent or more, or after an earlier impaired driving conviction, the term is 2 to 10 years with at least 2 served without probation or parole.
