G.L. c. 208, § 34 — the court may assign all or part of either spouse's estate
In Massachusetts, on a divorce the court may order either spouse to pay alimony to the other, and in addition or instead may assign to either all or part of the other's estate, including retirement benefits, pensions, deferred compensation and insurance accrued during the marriage.
- The length of the marriage and the conduct of the parties during it.
- Each party's age, health, station, occupation, income, vocational skills and employability.
- Each party's estate, liabilities and needs, and their opportunity to acquire capital and income in future.
- The amount and duration of any alimony.
