Calling For An Overdose
G.L. c. 94C, § 34A — no possession charge or probation violation from seeking help
In Massachusetts, a person who in good faith seeks medical help for someone's drug-related overdose is not charged or prosecuted for possession, or found in violation of probation, pretrial release or parole, on evidence gained because they sought help. The person who overdosed, who sought help or for whom it was sought, has the same protection.
- It does not prevent a charge of trafficking, distribution, or possession with intent to distribute.
- A person acting in good faith may get a naloxone prescription, possess naloxone, and give it to someone who appears to be overdosing.
