MCL 700.3983 — personal property by sworn statement after 28 days, up to $50,000 as adjusted
In Michigan, after 28 days from a death, a person who owes the person who died money, or holds their tangible personal property or stock, pays or delivers it to someone claiming to be the successor, on the death certificate and a sworn statement.
- The estate has no real property, and its whole value, net of liens, is no more than $50,000, as adjusted.
- Twenty-eight days have passed since the death.
- No personal representative has been applied for or appointed anywhere.
- It names everyone else entitled to a share, and the portion each takes.
The state court administrative office makes a standard form for the sworn statement, and the form warns that a false statement may be prosecuted as perjury.
