Carrying A Pistol
MCL 28.425f — the license, the immediate disclosure, and where it may not go
Stopped while carrying, the sections this page reads say, in short:
- A licensee carrying a concealed pistol who is stopped has to disclose it immediately, not on request.
- While carrying, the licensee has to have the license and a driver license or state ID.
- The license and the driver license or state ID have to be shown to a peace officer on request.
- A pistol in a vehicle needs a license to carry, whether concealed or not.
A pistol carried concealed on the person, or carried in a vehicle the person operates or occupies whether concealed or not, needs a license to carry, except in the person's own dwelling, place of business or other land the person possesses. Carrying without one is a felony punishable by not more than 5 years or a fine of not more than $2,500.
Stopped while carrying: the disclosure is immediate, not on request. A licensee carrying a concealed pistol who is stopped by a peace officer has to immediately disclose that a pistol is being carried, on the person or in the vehicle. Failing to is a civil infraction with a $500 fine and a 6 month suspension of the license for a first offense, and a $1,000 fine and revocation for another within 3 years.
While carrying, the licensee has to have both the license and a state issued driver license or identification card, and has to show both to a peace officer on request. Not doing so is a civil infraction with a $100 fine.
A licensee may not carry a concealed pistol on these premises, among others the section lists:
- A school or school property, with an exception for a parent or guardian in a vehicle dropping off or picking up a student.
- A child care center, a child caring institution or a child placing agency.
- A sports arena or stadium, and an entertainment facility seating 2,500 or more.
- A bar or tavern whose primary income is liquor sold by the glass and drunk there, except for its owner or employees.
- A place of worship, unless its presiding officials permit it.
- A hospital, and a dormitory or classroom of a college or university.
The list above is where a licensee may not carry a concealed pistol, and the section says premises does not include the parking areas of those places. Its exemptions, and open carry, are set out elsewhere and are not covered here.
