Disorderly Person
MCL 750.167 — what the statute lists, and 90 days
The section names these, among others, as a disorderly person:
- A person intoxicated in a public place who is either directly endangering the safety of another person or of property, or acting in a way that causes a public disturbance.
- A person engaged in indecent or obscene conduct in a public place.
- A window peeper.
- A person found begging in a public place, or jostling or roughly crowding people unnecessarily there.
- A person knowingly loitering where an illegal occupation or business is being conducted.
- A person of sufficient ability who refuses or neglects to support their family.
Up to 90 days, $500, or both. Being a disorderly person is a misdemeanor punishable by up to 90 days, a fine of up to $500, or both.
The section states that breastfeeding a child or expressing breast milk is not indecent or obscene conduct, whether or not the areola or nipple is visible.
Being intoxicated in public is not by itself on the list; the section adds endangering someone or property, or causing a public disturbance. Whether conduct fits a description is a question for the court.
