Passing A School Bus

MCL 257.682 — a full stop at least 20 feet back, and a civil fine of $100 to $500

In Michigan, a driver overtaking or meeting a school bus that has stopped and is showing 2 alternately flashing red lights comes to a full stop not less than 20 feet from the bus and does not go on until the bus moves or the signals are off. Not stopping, or passing, is a civil infraction with a civil fine of $100 to $500.

  • A driver on a highway divided into 2 roadways by a raised space, a barrier, or dividing sections built to impede traffic need not stop for a bus across it, except where there is a crosswalk or pedestrian walkway.
  • The registered owner of a vehicle shown to have passed is presumed to have been driving, and can rebut it.
  • A bus with a stop-arm camera can supply photographs or video as evidence, and an agency has 30 days after receiving the camera's information to review it and decide whether to issue a citation.
