Protests And Assembly
MCL 750.523 — refusing to depart from a riot or unlawful assembly when required makes a person one of those assembled
Required to depart. A person present who, when required by a magistrate or officer to depart from the place of a riotous or unlawful assembly, refuses or neglects to do so, is deemed one of the rioters or persons unlawfully assembled, and may be prosecuted and punished accordingly.
Commanded to assist. The same applies to a person commanded to help seize rioters or suppress the assembly who refuses or neglects to obey.
The right to assemble and to speak comes from the state and federal constitutions, and permits for marches and the use of public places are set by local rules; neither is on this page. Whether a particular order was lawful, or a particular gathering unlawful, is a question of fact and law for a licensed Michigan attorney.
