MCL 600.5775 — just cause to end a park tenancy
Just cause. In Michigan, a mobile home park tenancy may not be terminated unless there is just cause for it.
- Use of the site for an unlawful purpose.
- Failing to follow the lease, or a park rule reasonably related to health, safety, quiet enjoyment or the park's condition and appearance.
- Intentional injury to park staff or tenants, or intentional damage to park or tenant property.
- Failing to comply with laws on mobile homes, or public health and safety violations.
- Conduct that substantially annoys other tenants or the park, after notice and an opportunity to cure.
- Failing to keep the home or site in reasonable condition.
- Condemnation of the park, or changes in its use or nature.
Three late payments, with a warning. Late rent becomes just cause only on 3 or more occasions in any 12 month period, each after a written demand for possession that was not paid within the time it stated, and the demand must carry the notice: "Three or more late payments of rent during any 12-month period is just cause to evict you." The tenant may still raise defenses to the late payments.
Rent and terms after the lease. The section does not prevent a change in the rent or terms of the tenancy after a written lease for the site ends or expires.
